Financial and Corporate Restructuring and Insolvency

For more than four decades, the Kekst CNC team has helped clients manage through significant business challenges. Our restructuring experts have deep experience guiding companies large and small and across nearly every industry in (di)stressed situations, creditor negotiations, out-of-court and in-court restructurings – both consensual and contested – and workforce actions.

We pride ourselves on being value-added partners to our clients and their restructuring advisors, working seamlessly and effectively toward a common goal: to develop and implement comprehensive communications programs that build stability and credibility among a company’s key audiences, reinforce business continuity, and help achieve desired business and legal outcomes.

With expertise in a wide range of restructuring scenarios, we bring a proven approach to preparing and implementing highly-customized, multi-stakeholder communications that address the particular nuances of each and every situation. Our programs include the development of all messages and supporting materials to facilitate productive dialogue and anticipate potentially challenging developments throughout the process with a company’s most important audiences, including employees, lenders and other creditors, investors, customers, vendors and business partners, unions, retirees, communities, and regulators – as well as with the business media and restructuring-focused reporters.

The Kekst CNC team has led strategic communications in many of the largest, most complex, and highest profile restructuring situations and U.S. Chapter 11 cases in history. In addition to our extensive debtor work, Kekst CNC has represented creditors and groups of creditors in restructuring processes, including in adversarial situations.

Kekst CNC’s restructuring work crosses international borders, where jurisdictional and legal differences, cultural sensitivities, and regulatory obligations often require skilled communications advisors to tackle unique communications challenges. We understand the media and regulatory landscape and use communications to help accomplish our clients’ objectives at critical times in their business transformation and in planning for the future.

Our vast experience in the U.S. Bankruptcy Court extends beyond Chapter 11s to working with key stakeholders in some of the most visible Chapter 9 municipal restructurings and providing counsel in connection with cross-border insolvencies and Chapter 15 filings. We often combine our broad-based restructuring expertise with our extensive experience in M&A to assist clients through Section 363 sale processes, including in unsolicited acquisition attempts, and with divestments.
